John, hi,
> The BNSF licensing program covers their COPYRIGHTED logos. The
logos can be both trademarked and copyrighted. The UP (BNSF and
others) went to the trouble of copyrighting the predecessor logos.
Don't let anyone tell you otherwise, it is established law, the IP of
predecessor corporations is an asset of the sucessor corporation
unless reserved to another. John D. Mitchell, Jr. Attorney at Law <
What are the limitations on copyright, if any? Is there a time
limitation under which a copyright is in effect? If so, can copyright
be renewed? Renewed an unlimited number of times? Can copyright be
granted for items that long ago passed into public useage? (Fallen
flag railroad logos, for example. I have read that UP until recently
had not attempted to copyright these old logos.)
Where is the line on infringement drawn? Is my understanding correct:
Mass Comm Law 101, any photo taken from public property is legal (or
constitutional via SupCt rulings). Can a person publish, without
license, a book of photos about BNSF trains although the logo is seen
throughout the work?
Most interesting, perhaps, are you related to the John Mitchell of
CREEP and Nixon White House Fame. And if so, are you Deep Throat?
(I'm having fun here, I mean no harm.)
