I am the one that started this and I have no apologies. As a Librarian and
writer I can tell you the general attitude is they will not do anything or as
we have seen on this list, many persons own misconceptions. This is the law,
how ever you feel about it good or bad. As stated below, some companies have
people searching the net (the worse abuse of the copyright law) I did not want
the CBQ Historical Society or this list to be sued for some one breaking the
law. I as an author would give permission, but the publishing company would
not they are in the business to make money. But I can tell you when I had a
poem stole a verse added to the poem and it published all over the internet it
infuriated me to no end. I was given a public apology and the person admitted
to stealing (yes, that is what it is stealing, whether money was made or not.
Just as stealing movies by copying them). Let's drop this and continue with
the good information that is available here. Remember the item does not even
need to be published, as soon as it is written it is protected by the copyright
law. If you get something from someone else it is their idea and copyrighted.
A simple fix is use the correct citation (either MLA or APA) and attach it to
the item being used. Then it is for educational, intellectual use. Then if
someone else posts it somewhere else it is on them but not this list or the
owner of the list when the people come hunting you.

I didn't post the copyright information to start a war or make a personal

10 minutes of research on the internet and then believing what you read is
legal regarding copyright usage will sooner or later get you inextricably mired
down with copyright attorneys. I'm not a copyright attorney. But I employ one
to handle our needs.
Internet usage is a slippery slope. Fair Use most commonly pertains to
certain, limited parts of an article reprinted in a review, not the entire
article being reproduced. That is not Fair Use.
The only people Railway Age might pursue would be Mark and Dave. Everyone
else skates away.
I only posted the information to illuminate the popular misconceptions about
fair use and public domain. I did that because Railway Age/Progressive
Railroading are very protective of their copyrighted material. The material
they published is an asset of their corporation. To use it without permission
is stealing, like it or not.
So if you are offended by the rules, fine. Do whatever you want.
If you are industrious, call Simmons-Boardman. Ask them about this specific
article, its intended use and then ask them to send you a letter authorizing
the use. Upload the letter to the list.
Remember the U.P. licensing fiasco. If these guys think they can make a buck
they will. They hire outside companies that do nothing but troll the internet
using sophisticated search engines to look. Then they send a letter and an
invoice.
So who pays when everyone else skates away? Mark and Dave.
