I believe that on most properties where the BLE held the engineers' contract, engineers were set up in strict seniority order. The local chairman and local management would look at manpower needs and draw a line on the seniority roster - everybody above the line was an engineer, everybody below the line was a fireman. (I spent a lot of time at the bottom of the engineers' list - forced assigned as 'junior' man to midnight switch engines halfway across the state. The man behind me in seniority was at the top of the firemens' list and had his pick of regular passenger jobs.)
There were provisions for a junior man to 'set himself up' as an engineer at an outlying point if he did not want to work as a fireman out of his home terminal. Engineers could also be 'restricted' (not set back) to yard work, generally for medical reasons. When the semaphores were taken down on the mainline the Company found it had a few color-blind engineers on the roster.....................PAW

I don't know about engineers chucking their rights but I do know engineers that got "set back" usually for medical reasons.

We have previously discussed the widesread practice of Q brakemen(particularly on the Aurora Div) of giving up their Condrs rights under Schedule Rule 72. Commonly referred to as "chucking your rights". This was done to stay on a preferred run or runs when it was time to be promoted to Condr,which meant starting all over working the least desirable jobs but as a Condr. Hundreds of men followed this path over the decades so as to stay on Zephyrs,dinkies and preferred wayfreights rather than go work the Condrs extra list,etc.
 
Of course this didnt always completely work out in the 50s,60s and 70s as passenger jobs came off in droves.
 
But a question has come to mind, that despite research into the Engineers schedule, I can't locate the answer. Could a fireman chuck his engineers rights ? Obviously by the 50s this wasn't an option as jobs came off, but in the prior times ? I checked my stash of seniority lists but do not have enginemans rosters handy that would answer this query.
