The responses to my initial posting about the CZ brochure gaffe have all been
very thoughtful and informative. Although I have been a devoted Burlington fan
since the 1950s I had never heard of this story before, and from these
responses I gather many other Burlington fans hadn't heard of the story either.
So, it was good to have confirmation from others, much more knowledgeable than
myself, that the story is indeed true. Of course, in the overall scheme of
things it is just an amusing anecdote, a bit of a esoteric trivia that makes
for interesting conversations, and inquiry by devoted groups such as this one
It's also interesting to learn that it's more widely known in WP circles
because it appeared in a WP publication. That places the general lack of
knowledge of the story in a good context, i.e., it was more regional.
Indeed, it might be an interesting piece of paper railroadiana to add to one's
own private collection, but it's probably a good idea not to take a scan of it,
even for this group's archives. If one does it almost certainly will find its
way onto the Internet and achieve international circulation. This could produce
legal problems, especially if that waiter is still living. Such wide
publication of a photo like that which makes him look ridiculous and turns him
into laughing stock would be libelous. Possessors of this brochure or photo
should be very cautious here. Possible legal liability is precisely what
motivated the three railroad Presidents to get those brochures out of
circulation as soon as they could. In fact, according to the documentary I saw
the waiter was in fact paid a handsome sum for any harm the photo had already
caused him.
Possible legal liability is also the probable reason the photo does not appear
in either "Portrait of a Silver Lady" or "The Story of the California
Zephyr".
