Brkmn Harmon is holding a pool turn out of Clyde. On 2/8/47 the trainmasters
clerk calls him to D.H. to CUS to protect #49 instead of his pool turn.He
puts on his uniform and D.H.s and works #49 and 1/44 home on the 9th. On the
10th the clerk again calls him but this time for the Irsih Mail and its 6
degrees. At this time the Irish Mail is a 12 to 16 hour workhorse. He
declines the call as his heavy overclothes,boots,gloves,etc are in the w/c
which is now back in Clyde(the turn returned the 9th).Later in the day Harmon
is again called by the crew caller to move up several turns in the pool to
protect another car. He does so and justifies the conflict between turning
down the Irish Mail and the earlier pool turn by stating he can recover his
gear from his regular w/c in Clyde before moving over to the other Conductors
car.
Brkmn Harmon turns in a timeslip for the difference in pay between what his
pool turn made on the 8th and 9th and what he earned in passenger service.
Trnmstr Benedetto turns him down because Harmon turned down the Irish Mail.
How do you rule in this case? Is Harmon entitled to the difference in pay on
the 8th and 9th?
